RoadComm, Inc. ("RoadComm") values the privacy of our customers, users, and others who use the mobile phone applications, www.LifeInPocket.com, and other web sites or services owned or operated by RoadComm (the "RoadComm Services") (collectively or individually "Users").

The great majority of our Users will use the RoadComm Services for harmless and fun personal and social purposes. However, please note that by its very nature, your real-time location information is subject to abuse, misuse, and over-monitoring by others – including, perhaps, by your friends, family, or acquaintances. Please manage your own mobile and profile privacy preferences on the RoadComm Services, on an ongoing basis, accordingly. Send your location only to friends and family you can trust!

Please be aware that due to the nature of Internet Protocol, your information transfer over Internet maybe venerable.

General Information:

This Privacy Notice details important information regarding the use and disclosure of User information collected through the RoadComm Services. RoadComm provides this Privacy Notice to help you make an informed decision about whether to use or continue using the RoadComm Services.

This Privacy Notice is incorporated into and is subject to the RoadComm Terms of Use. Your use of the RoadComm Services and any personal information you provide on the RoadComm Services remains subject to the terms of this Privacy Notice and the Terms of Use.

Location Information Disclosures and Consents:

Disclosures. The RoadComm Service allows you to navigate, send Location Based Instant Messages and offer emergency services . The GPS location message, as part of the RoadComm Service, will not obtain your GPS location unless you selected to. That means your phone obtains location message only at the time you use these location based services.

Consents. You hereby expressly agree and consent to RoadComm's use of Location Data to provide the RoadComm Services. You hereby expressly agree and consent to disclosure of your Location Data to friends that you voluntarily select on the RoadComm Service, and to other RoadComm partners, contractors and successors, and as permitted by law. You hereby expressly agree that RoadComm may terminate your subscription without notice and for any reason. You expressly agree to receive Internet advertisement, from RoadComm and you acknowledge that normal carrier charges and taxes may apply to data and SMS text messages to and from RoadComm's services.

The Information RoadComm Collects:

User Provided Registration Information: When choosing to subscribe to the RoadComm Services, you provide to RoadComm certain "personally identifiable" information (such as mobile phone number, wireless carrier / operator, your name, email address, etc.)
User Provided Profile Information: When choosing to create a personal profile page on the RoadComm Services, to review events and venues, to post event announcements, or to send messages to other Users, you provide at your option certain personal information that will be publicly displayed to other Users on the RoadComm Services.
Location Information: RoadComm receives location information from your mobile phone and your mobile carrier.
Cookies, Persistent File Information: When you visit the RoadComm Services, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your computer. RoadComm uses both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the RoadComm Services. Persistent cookies can be removed. Please review your web browser "Help" file to learn the proper way to modify your cookie settings.
Log File Information: When you use the RoadComm Services, our servers automatically record certain information from your mobile device or web browser. These server logs may include information such as a mobile device identification number and device identifier, your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.
Clear Gifs Information: When you use the RoadComm Services, we may employ "clear gifs" (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear gifs in HTML-based emails sent to our Users to track which emails are opened by recipients.

The Way RoadComm Uses Information:

RoadComm uses your personally identifiable information and your location information to operate, maintain, and provide to you and our other Users the features and functionality of the RoadComm Services.
RoadComm uses your personally identifiable information, your location information, and certain non-personally-identifiable information (such as anonymous User usage data, cookies data, browser type, clickstream data, etc.) to improve the quality and design of the RoadComm Services and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.
RoadComm uses cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the RoadComm Services; (b) provide custom and personalized content, advertisements, and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

We do not use your personally identifiable information to send commercial or marketing messages without your express consent or except as part of a specific program or feature for which you will have the ability to opt-in. We may, however, use your email address or mobile number without further consent for non-marketing or administrative purposes (such as notifying you of major RoadComm Services changes or for customer service purposes).
Our server may use your location information to send location based advertisement..

When RoadComm Discloses Information:

We do not share your personally identifiable information or location information with other, third-party companies for their commercial or marketing use without your express consent or except as part of a specific program or feature for which you will have the ability to opt-in.
We provide personally identifiable information, location information, and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of providing certain RoadComm Services features and for processing such information on our behalf. For example, we may share information with our wireless carrier partners for the purpose of revenue recognition, or we may share information to offer mapping or directions features. We require that these parties agree to process such information in compliance with our privacy policy, we use reasonable efforts to limit their use of such information, and we require these parties to use any other appropriate confidentiality and security measures.
We provide non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist those parties in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the RoadComm Services.
We may release personally identifiable information, location information, or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws) or respond to a court order, subpoena, or search warrant.
RoadComm also reserves the right to disclose personally identifiable information, location information, or non-personally-identifiable information that RoadComm believes, in good faith, is appropriate or necessary to: enforce the Terms of Use; take precautions against liability; protect Users from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of our web site; and to protect the rights, property, or personal safety of RoadComm, our Users, or others.

Your Decision:

When you send your location information to your friends and family, we will not be able to prevent them from record your location or pass it to others even though we do not allow forward of your location in our system.
To protect your privacy and security, we take reasonable steps to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times. We do not store any location information history unless you give us express permission, and then we store it in such a way that it cannot be tied to your profile or account without your password.

Third-party Advertisers, Links to Other Sites:

RoadComm may allow other companies, called third-party ad servers or ad networks, to serve advertisements within the RoadComm Services. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the RoadComm Services. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content.

You should consult the respective privacy policies of these third-party ad servers or ad networks. RoadComm's privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites.

RoadComm does not provide any personally identifiable information or location information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in.

Our Commitment To Data Security:

RoadComm uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information that RoadComm receives on your behalf to operate the services or that you transmit to RoadComm and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If RoadComm learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. RoadComm may post a notice on the RoadComm Services if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should contact our Privacy Manager at privacy@RoadComm.com.

International Visitors:

The RoadComm Services are hosted in the United States and are intended for United States visitors. If you are using the RoadComm Services from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States and by providing your personal data you consent to that transfer.

In the Event of Merger, Sale, or Bankruptcy:

In the event that RoadComm is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

Changes and updates to this Privacy Notice:

This Privacy Notice may be revised periodically without further notice to you and this will be reflected by the "last modified" notice below. Please revisit this page to stay aware of any changes. In general, we only use your personal information in the manner described in the Privacy Notice in effect when we received that personal information. Your continued use of the RoadComm Services constitutes your agreement to this Privacy Notice and any future revisions.

For revisions to this Privacy Notice that may be materially less restrictive on our use or disclosure of personal information you have provided to us, we will make reasonable efforts to notify you and obtain your consent before implementing such revisions with respect to such information.
